Abstract:

Cílem mé diplomové práce je popsat právní úpravu skončení pracovního poměru v českém právu a provést charakteristiku této úpravy také v právu Ruské federace a Spojených států amerických v porovnání s českou úpravou v souvislosti se záměrem novelizovat český zákoník práce a omezit tak rigiditu této úpravy. První kapitola se zaměřila na povahu a zásady pracovního práva. Druhá kapitola se platnou právní úpravou způsobů skončení pracovního poměru s výjimkou okamžitého zrušení pracovního poměru. Čtvrtá kapitola se věnuje právní úpravě skončení pracovního poměru v ruském a v americkém právu a zabývá se také otázkou přílišné rigidity českého pracovního práva, zejména ve vztahu ke skončení pracovního poměru v souvislosti s návrhy na novelizaci zákoníku práce.

Abstract:

The aim of my diploma thesis is to describe the legal regulation of termination of employment in Czech law and to characterize this regulation also in the law of the Russian Federation and the United States of America in comparison with the Czech regulation in connection with the intention to amend the Czech Labor Code and thus limit the rigidity of this regulation. The first chapter focused on the nature and principles of labor law. The second chapter with the valid legal regulation of the methods of termination of the employment relationship, with the exception of immediate termination of the employment relationship. The fourth chapter deals with the legal regulation of termination of employment in Russian and American law and also deals with the issue of excessive rigidity of Czech labor law, especially in relation to termination of employment in connection with proposals to amend the Labor Code.
