Caves from the Legal Point of View

Abstract:

Cílem této bakalářské práce je objasnit právní úpravu ochrany a využití jeskyní jako i rozbor kompetencí institucí zabezpečujících tuto ochranu. Přiměřená pozornost je věnována i majetkoprávní problematice jeskyní. Úvodní část práce je zaměřena jak na vznik prvních organizací věnujících se ochraně jeskyní, tak i na vývoj právní úpravy poskytující ochranu jeskyním od poloviny 20. století až po současnost. Vzhledem k nezastupitelnému místu orgánů ochrany přírody při ochraně jeskyní je proveden rozbor kompetencí jednotlivých orgánů ochrany přírody a jejich působnosti na úseku ochrany jeskyní. Závěrečná část práce je věnována problematice veřejnosti zpřístupněných jeskyní na příkladu Zbrašovských aragonitových jeskyní a to především v linii přísných báňských předpisů upravujících podmínky umožňující zpřístupnění jeskyní veřejnosti. Tato práce nabízí ucelený pohled na tuto neprávem opomíjenou problematiku, komplexně shrnuje zdroje upravující tuto problematiku, poukazuje na problematické otázky způsobené stávající právní úpravou a u některých nastiňuje možná řešení.

Abstract:

The main objective of this Bachelor thesis is to clarify the legislation on the protection and utilization of caves, as well as the analysis of the jurisdiction of institutions providing this protection. Also, an adequate attention is paid to the problems affecting property rights of caves. The introductory part of the thesis concentrates not only on the rise of the first organizations dealing with the protection of caves, but also with the development of the legislation providing caves with the protection from the first half of the 20th century to the present. With regard to the irreplaceable role of the authorities in the protection of caves, the analysis of both the jurisdiction of respective authorities dealing with the protection of caves and their competences in these matters is carried out. The final part of the thesis explains issues of caves open to the public on the example of Zbrašovských aragonitových caves mainly in the policy of strict mining regulations regulating conditions in caves open to the public. This thesis offers self-contained and coherent view on this unjustly neglected area, comprehensively summarizes sources dealing with this issues, points out some questionable issues caused by the current legislation and suggests some possible solutions.
