Disposition of the Natural Persons Real Property

Abstract:

Tématem této bakalářské práce je nakládání s nemovitostmi ve vlastnictví fyzických osob. Cílem je poskytnout základní přehled o jednotlivých způsobech nakládání s nemovitostmi a podmínkách, které je nutno splnit. Práce má rovněž upozornit na některé vady, které se často vyskytují a způsobují při nakládání s nemovitostmi problémy – zejména pak neplatnost příslušných smluv. Po úvodu práce následuje obecná kapitola, kde jsou představeny některé základní pojmy, jako je nemovitost či nakládání s nemovitostmi. Další část práce obsahuje stručné představení jednotlivých způsobů nakládání s nemovitostmi. Poté je zařazena kapitola, která je hlavní částí práce. V této kapitole se zabývám kupní smlouvou jakožto nejpoužívanějším smluvním typem, na jehož základě dochází k nakládání s nemovitostmi. Jedna kapitola je rovněž věnována daňovým aspektům. Závěr práce obsahuje shrnutí a rovněž upozornění na některé časté problémy, které v praxi nastávají.

Abstract:

The theme of this Bachelor thesis is handling with the real estate in the ownership of natural persons. The aim is to provide the overview of the ways of handling with the real estate and conditions to be fulfilled. The Thesis should also point out some faults, which frequently occur and which cause problems in relation with handling with the real estate – especially the invalidity of the respective contract. The introduction of the Thesis is followed by the general chapter, where some basic terms, such as real estate or handling with the real estate are introduced. The next part of the Thesis includes a short presentation of the specific ways of handling with the real estate. Next chapter is the main part of the Thesis. In this chapter I deal with the purchase contract, which is the most frequently used contract type, the handling with the real estate is based on. One chapter also deals with the tax aspects. The conclusion includes summarization of the Thesis and also warning against some frequent problems, which occur in practice.
