Common European Sales Law as an Alternative to the UN Convention on Contracts for the International Sale of Goods

Abstract:

The main goal of the submitted thesis is to analyze the Common European Sales Law (hereinafter the "CESL") in the light of existing legislature, specifically the UN Convention on Contracts for the International Sales of Goods (hereinafter the "CISG"). The result of the analysis shall reveal, whether the CESL is capable of providing solution for the parties to avoid the most serious drawbacks of the CISG. Hence, it shall in broader view show, whether the effort for creating the CESL is worthwile.

Abstract:

Hlavným cieľom predloženej diplomovej práce je analyzovať pripravované Spoločné Európske Kúpne Právo (ďalej len "CESL") z pohľadu už existujúcej legislatívy, konkrétne Dohovoru OSN o Zmluvách o Medzinárodnej Kúpe Tovaru (ďalej len "CISG"). Výsledkom analýzy bude zistenie, či CESL stranám ponúkne riešenie ako sa vyhnúť najzávažnejším nedostatkom úpravy CISG. V širšom význame práca ukáže, či je snaha o vytvorenie CESL užitočná.
