Sexual Harassment of Women in Labour - Law Relations

Abstract:

Bakalářská práce, jež je psána formou odborné přehledové stati, se věnuje problematice sexuálního obtěžování. Konkrétně je tato práce zaměřena na sexuální obtěžování žen v pracovněprávních vztazích. Stať přibližuje samotný vstup žen do pracovního procesu a to v souvislosti s formováním soukromé a veřejné sféry. Upozorňuje na genderové aspekty tohoto vývoje. Práce se opírá o přehledy závěrů z dosavadních studií, zabývajících se sexuálním obtěžováním, jak v České republice, tak ve světě. Práce osvětluje specifika daného fenoménu, jako jsou jeho příčiny, formy a důsledky. Přibližuje sexuální obtěžování jako fenomén, jež je úzce spjat s genderovou strukturou společnosti, která zkoumaný fenomén ovlivňuje. Jak analýza ukazuje, genderové nastavení společnosti je primární příčinou sexuálního obtěžování. Sexuální obtěžování odráží genderové nastavení dané společnosti. Stať reflektuje analyzované sexuální obtěžování jako formu genderové diskriminace – jako jev, který vytváří bariéry znemožňující nastolení genderové rovnosti. Bakalářská práce navíc vypovídá o sexuálním obtěžování jako o mechanismu, který dále šíří genderové nerovnosti existující na trhu práce. Analýza odhaluje, jakými aspekty se zkoumaný fenomén podílí na této reprodukci genderových nerovností na pracovišti. Práce se snaží poukázat na sexuální obtěžování jako na problém, který se týká celé společnosti, nejen jedinců, kteří sexuální obtěžování sami zažili.

Abstract:

The Bachelor Thesis, written in the form of an overview treatise deals with the topic of sexual harassment. This work specifically focuses on sexual harassment of women in labour-law relations. The treatise explains the entry of women into the employment process, in connection with the formation of private and public spheres. It also highlights gender aspects of this development. The work draws from the summary of previous findings in actual studies dealing with sexual harassment, both in the Czech Republic and abroad. The work discloses the characteristics of an existent phenomenon, such as causes, forms and consequences. It outlines sexual harassment as a phenomenon which is closely linked to the gender structure of society, which affects this observed phenomenon. As the analysis shows, gender setting of our society is the cause of sexual harassment. Sexual harassment reflects the gender setting of our given society. The article reflects the analysed sexual harassment as a form of gender discrimination – as a phenomenon that creates barriers precluding establishment of gender equality. Besides, this Bachelor Thesis predicates about sexual harassment as a mechanism that furthermore expands gender inequalities existing in the labour market. The analysis reveals by which aspects the surveyed phenomenon contributes to this reproduction of gender inequality in the workplace. The work tries to point out sexual harassment as a problem that concerns the entire society and not only individuals who themselves have experienced sexual harassment.
