Abstract:

Předmětem diplomové práce je analyzovat vliv evropské antimonopolní politiky a regulace síťových odvětví na trh s plynem v České republice. Ve své první části se práce zabývá různými ekonomickými přístupy k problematice monopolu a jeho regulace. Tato část se dále zabývá teoretickými východisky současné antimonopolní politiky a upozorňuje na sporná místa. Druhá část je věnována legislativě. Popisuje vznik a vývoj evropské antimonopolní legislativy a právní úpravy trhu s plynem. Následuje charakteristika české právní úpravy, která z té evropské vychází. Ačkoli se jedná o „právnickou“ část, soustřeďuje se zejména na ekonomické aspekty legislativního rámce. Třetí část usiluje o komplexní analýzu vývoje trhu s plynem v České republice prakticky od jeho vzniku, zejména však za období let 2004-2010. Zvláštní důraz je kladen na analýzu změn, ke kterým došlo v souvislosti s implementací evropské legislativy.

Abstract:

The goal of the submitted thesis is to analyze the impact of the European antimonopoly policy and regulation of network industries on the gas market in the Czech Republic. In its first part the thesis deals with various economic approaches to monopoly issue and its regulation. This part is further concerned with theoretical resources of current antimonopoly policy and draws attention to its points of controversy. The second part is devoted to the legislation. It describes the creation and evolution of the European antimonopoly legislation and legal framework of the gas market. The characteristic of the Czech legal framework follows, which comes from the European one. Though it is a „juristic“ part, it focuses on the economic aspects of the legal framework. The third part aims to give a comprehensive analysis of the gas market in the Czech Republic since its origin, but especially from 2004 to 2010. A special stress lays on analysis of changes which came from the implementation of the European legal framework.
