Abstract:

Tato bakalářská práce se zabývá problematikou služebního a pracovního poměru.Zaměřuje se na jejich komparaci, odlišnosti, specifikace i společné znaky. V práci jsou využity metody komparace, obsahové analýzy a syntézy. Pro vznik služebního poměru jsou vytyčeny významně přísnější podmínky oproti obecným legislativním požadavkům na vznik poměru pracovního.Změna pracovního služebního poměru se odlišuje především ve své struktuře a rozsahu. Naproti tomu podmínky zániku obou poměrů si jsou vzájemně velmi podobné.Pokud vedlejší výdělečná činnost příslušníka PČR nemá negativní vliv na výkon služby, služební funkcionář má možnost její výkon povolit. Možnost udělení služebního volna sice právní řád ČR příslušníkům stanovuje v nutném rozsahu s ohledem na rozsah konkrétní formy studia.Zákon o služebním poměru stanovuje poměrně rozsáhlý výčet kázeňských trestů.

Abstract:

This bachelor thesis deals with the issue of employment in police forces and usual employment. It focuses on their comparison, differences, specifications and common features. Methods of comparison, content analysis and synthesis are available in this work. Significantly stricter conditions for general employment requirements for achieving an employment relationship are set for the establishment of an employment relationship. The change in employment differs from the others in structure and scope. In contrast, the conditions for the extinction of both conditions are also very similar. Pleasant gainful activities of a member of the Parliament do not have a negative effect on the performance of the service, services, officials and the possibility to allow their performance. The possibility of granting service law with regard to the legal orders of the Czech Republic can also be ensured within the framework of specific forms of study. The Employment Act makes it possible to establish an extensive list of disciplinary punishments.
