Employee’s claims at work accidents and occupational disease

Abstract:

Cílem mé práce je analyzovat problematiku odpovědnosti zaměstnavatele za pracovními úrazy a nemoci z povolání a zhodnotit smysl a význam uvedených právních předpisů s judikaturou a fakty, které vyplývají z praktického využití těchto předpisů. Práce je uspořádána do kapitol, které se vztahují k tématům souvisejícím s pracovními úrazy a nemocemi z povolání. V práci je zpočátku uvedena interpretace odpovědnosti s charakteristickými znaky, které působí na okruh pracovních úrazů a nemocí z povolání. Další kapitola se zabývá podrobným definováním podmínek pracovního úrazu a nemoci z povolání. Čtvrtá kapitola charakterizuje nařízení, jehož záměrem je uskutečnění prevence. Pátá kapitola se zabývá povinností zaměstnavatele při pracovních úrazech a nemocech z povolání. Šestá kapitola uvádí způsob řešení a eventualitu zproštění se povinnosti. Sedmá kapitola se zabývá druhy náhrad poskytovaných postiženému zaměstnanci nebo jeho pozůstalým. Osmá kapitola pojednává o zákonném pojištění odpovědnosti zaměstnavatelů. Poslední kapitola se zabývá praktickou částí práce. Výsledkem vypracování zvoleného tématu je souhrnná charakteristika základních pojmů a posouzení zvolených právních předpisů.

Abstract:

The aim of the thesis is to analyze employer´s liability for the cases of work accidennt and professional disease and to assess the meaning and sense of those laws with the practice of the judicature and the facts resulting from the practical use of these regulations. The thesis is divided into chapters relating to the topics connected with work accident and professional disease. In the beginning the thesis presents the interpretation of liability with characteristic features which effects the range of work accident and professional disease. The following chapter deals with the detailed definition ot the terms of work accident and professional disease. The fourth chapter describes the regulation that leads to the implementation of prevention. The fifth chapter is concerned with the employer´s liability for work accident and professinal disease. The sixth chapter presents the way of solution and the possibility of the waiver of obligation. The seventh chapter describes the types of refundings granted to affected employee or his survivors. The eighth chapter is concerned with employer´s legal liability insurance. The last chapter is the practical part of the thesis. The general characteristics of the basic terms and the assessment of selected legislation is the result of the chosen topic´s working out.
