Obligations of Public Sewerage System Owner

Abstract:

Bakalářská práce se zabývá povinnostmi vlastníka kanalizace pro veřejnou potřebu. Pojednává o povinnostech, které vyplývají vlastníkovi kanalizace na základě zákona o vodovodech a kanalizacích z titulu jejího vlastnictví. Úvodní části práce se věnují vymezení legislativního rámce a úvodu do problematiky kanalizací pro veřejnou potřebu, ve vztahu k povinnostem vlastníka kanalizace je zpracována působnost jednotlivých orgánů veřejné správy i sankce za porušení těchto povinností. Hlavní pozornost je soustředěna na jednotlivé povinnosti podle zákona o vodovodech a kanalizacích. Cílem práce bylo metodou popisu a analýzy shrnout stávající právní úpravu v oblasti povinností vlastníků kanalizace pro veřejnou potřebu a poukázat na problematická místa současné právní úpravy. Na základě rozboru problematických míst současné právní úpravy jsou v práci obsaženy také úvahy de lege ferenda.

Abstract:

This bachelor thesis deals with the obligations of the owner of the public sewerage system. It discusses the obligations imposed on the sewerage system owner by the law on the water supply and sewerage system by the fact of the ownership. The introductory parts of this paper deal with the definition of the legal framework and introduction into the matter of the public sewerage system; in connection to the obligations of the sewerage system owner, the sphere of action of particular public administration bodies is explained, as well as the penalties for infringement of the obligations. The main focus of the work is aimed to the individual obligations according to the law on water supply and sewerage system. The goal of this paper is to give a summary of current legal regulations in the area of obligations of the public sewerage system owners by their description and analysis, and point out the disputable parts of the current legal regulations. Based on analysis of the problematic parts of the current regulations, also considerations de lege ferenda are included in this work.
