Insolvence proceeding, its forms and impacts against accounting

Abstract:

Cílem této práce je seznámit čtenáře s nejnovější právní normou, Insolvenčním zákonem, který se týká úpadku a způsobů jeho řešení. V první části charakterizuji celou úpravu, způsoby řešení úpadku a vysvětluji důležité pojmy, které jsou do zákona aplikovány jako zcela nové, ale i ty, které známe již ze zákona o konkursu a vyrovnání, ale je třeba si je představit v nových souvislostech. Vzhledem k obsáhlosti insolvenčního zákona se nelze věnovat všem formám úpadku a způsobům jeho řešení, proto se zaměřuji pouze na konkurs a oddlužení. Tyto způsoby řeším i v praktické části práce, která přibližuje průběh řízení na skutečných případech konkursu a oddlužení, což je nový způsob řešení úpadku pro nepodnikatele. V praktické části aplikuji nabyté teoretické vědomosti na příkladu konkursu malé obchodní společnosti, který nakonec insolvenční správkyně definuje jako nepatrný, a oddlužení mladé ženy s dětmi, která se díky spoustě okolností velice zadlužila. V závěru práce zmiňuji i dopady insolvenčního řízení na účetní evidenci dlužníka a věřitelů.

Abstract:

The aim of this work is to inform the readers about the latest judicial standards in the Insolvency Act which deals with bankruptcies and methods of their settlements. In the first section I am describing the entire aspects, methods of dealing with bankruptcies and I am explaining certain important definitions which were newly applied in the law, but also the ones which we already know from the Bankruptcy and Composition Act, but which we now need to perceive in the new relevancies. Considering the complexity of the Insolvency Act it was not possible to concentrate on all forms of bankruptcies and methods of their settlements and therefore I am only focusing on bankruptcy proceedings and debt relief. I am dealing with these methods even in the practical section of the work which describes the procedures in the real cases of bankruptcy proceedings and debt relief, which is a new method on how to deal with personal bankruptcies. In the practical section I am applying my theoretical knowledge in the example of bankruptcy proceedings involving a small company, which at the end was defined by the bankruptcy trustee as a minor case and in another example involving debt relief granted to a young woman with children who as a result of various circumstances became heavily indebted. In the final section of my work I am discussing the effects of insolvency proceedings on the accounting records of debtors and creditors.
