The protection of personal data in practise

Abstract:

In my bachelor work I am analysing the current legislative situation in the area of the personal data protection in connection with its practical application in the company Slovenský plynárenský priemysel, a.s. Bratislava. I divided my work into three chapters. In the first chapter I deal with the development of the legislative protection of the privacy in the Slovak Republic, I introduce the legislative and legal aspects, the solutions and the principles of the private data protection. The second chapter is dealing with introducing the subject of the entrepreneurship and the organisational structure of the operating components of a selected company which collects and protects the personal data. In this part I also introduce the chosen key risks of breeching the personal data protection I identified in my work. Furthermore I also describe the processes of the personal data protection ensured in the company, the area as well as the vulnerability of the working procedures from the level of the most hazardous segment of the whole process – the human being. The third chapter is analysing the state of the personal data protection in a chosen company. Based on the realised analysis I evaluate the identified risks in relation to the legislative environment and the valid organisational standards and the working procedures. The way of eliminating the risks is a continuous process of evaluating the individual steps, as shown in the development diagram. One part of the third chapter also shows a proposal for working out the safety guideline for the personal data protection for the given company. In the proposed structure of the safety guideline I recommend a complexity of the solution in relation to the identified risks and the focus areas where the rise or the increase of the risk is a limiting factor.

Abstract:

V mojej bakalárskej práci analyzujem súčasnú legislatívnu situáciu v oblasti ochrany osobných údajov v nadväznosti na praktickú aplikáciu v spoločnosti Slovenský plynárenský priemysel, a.s. Bratislava. Prácu som rozdelila do troch kapitol . V prvej sa zaoberám vývojom právnej ochrany súkromia v Slovenskej republike, uvádzam legislatívno – právne aspekty, východiská a zásady ochrany osobných údajov. Druhá kapitola je venovaná predstaveniu predmetu podnikania a organizačnej štruktúre prevádzkových zložiek vybranej spoločnosti, ktoré sa zaoberajú zhromažďovaním a ochranou osobných údajov. V tejto časti práce uvádzam aj vybrané kľúčové riziká porušenia ochrany osobných údajov, ktoré som pri analýze identifikovala. Ďalej tiež popisujem procesy ochrany osobných údajov zabezpečovaných v spoločnosti, problematiku a zraniteľnosť pracovných postupov z úrovne najrizikovejšieho článku celého procesu – človeka. V tretej kapitole analyzujem stav ochrany osobných údajov vo vybranej spoločnosti. Na základe uskutočnenej analýzy hodnotím identifikované riziká vo vzťahu k legislatívnemu prostrediu a platným organizačným normám a pracovným postupom. Spôsob eliminácie rizík je priebežný proces hodnotenia jednotlivých kľúčových rizík. Súčasťou tretej kapitoly je návrh na spracovanie bezpečnostnej smernice na ochranu osobných údajov pre danú spoločnosť. V navrhovanej štruktúre bezpečnostnej smernice odporúčam komplexnosť riešenia vo vzťahu k identifikovaným rizikám a ťažiskové oblasti u ktorých je vznik alebo nárast rizika limitujúcim faktorom.
