Abstract:

Tato bakalářská práce se zaměřuje na analýzu dodržování sedmi základních zásad správního řízení: zákonnosti, ústavnosti, spravedlnosti, účelnosti, transparentnosti, důkazního břemene a přiměřenosti. Cílem práce bylo zjistit, jak jsou tyto zásady aplikovány a dodržovány v praxi, prostřednictvím polustrukturovaných rozhovorů s třemi odborníky, kteří mají bohaté zkušenosti v oblasti správního práva. V teoretické části práce jsou tyto zásady definovány a je popsán jejich význam a role v rámci správního řízení. Praktická část se zabývá konkrétní aplikací těchto principů na základě rozhovorů s odborníky, které poskytly hluboký vhled do reálného uplatňování zásad v různých správních situacích. Výsledky ukazují, že ačkoliv jsou zásady správního řízení obecně dodržovány, existují výzvy a nedostatky, které je potřeba řešit.

Abstract:

This bachelor thesis focuses on the analysis of compliance with the seven basic principles of administrative management: legality, constitutionality, fairness, expediency, transparency, burden of proof and proportionality. The aim of the work was to find out how these principles are applied and adhered to in practice, through semi-structured interviews with three experts who have extensive experience in the field of administrative law. In the theoretical part of the thesis, these principles are defined and their significance and role in the framework of administrative management are described. The practical part deals with the concrete application of these principles on the basis of interviews with experts, which provided a deep insight into the real application of the principles in various administrative situations. The results show that, although the principles of administrative management are generally respected, there are challenges and shortcomings that need to be addressed.
