Trade unions in Czech Republic - structure, activities, operation

Abstract:

Odborové organizace jsou v České republice jedním z nejsilnějších subjektů občanské společnosti, který vůči politické reprezentaci hájí zájmy svých členů. Jejich výjimečné postavení je dáno historickým kontextem, ale také právním řádem České republiky, který jim k prosazování jejich zájmů poskytuje různé nástroje. Cílem práce je zmapování těchto nástrojů, způsobu a intenzity jejich využívání současnými odbory. Ke zpracování práce byla užita analýza odborné literatury, právních předpisů a jiných dostupných materiálů a následná analýza využití těchto nástrojů v rámci tří případových studií zaměřených na aktivity Česko-moravské konfederace odborových svazů (dále jen „ČMKOS“), jako nejvýznamnější odborové centrály v České republice. Prví kapitola se věnuje teoretickému zakotvení odborů v občanské společnosti, jejich funkci v rámci sociálního dialogu a vymezení vybraných významných nástrojů, prosazování jejich politiky. Druhá kapitola se věnuje historickému vývoji odborů a jejich nástrojů na území ČR. Třetí kapitola analyzuje právní rámec existence a činnosti odborových organizací. Závěrečná kapitola analyzuje užití nástrojů prosazování zájmů v rámci tří případových studií zaměřených na aktivity ČMKOS v období od roku 2003 do roku 2019.

Abstract:

In the Czech Republic, trade unions are one of the most powerful actors in civic society, protecting their members' interests against political representation. The historical setting as well as the legal system of the Czech Republic, which equips them with different instruments to advance their interests, provide them an extraordinary position. The aim of the thesis is to map these instruments, as well as the ways and extents to which they are used by current trade unions. The thesis was based on an examination of scholarly literature, legal regulations, and other available materials, as well as an examination of their application in three case studies focusing on the activities of the Czech-Moravian Confederation of Trade Unions - Českomoravská konfederace odborových svazů (hereinafter "ČMKOS"), the most important trade union headquarters in the Czech Republic. The first chapter examines the theoretical foundations of trade unions in civil society, their role in social dialogue, and the definition of key instruments for advancing their agendas. The second chapter focuses on the historical evolution of trade unions and their instruments in the Czech Republic. The third chapter examines the legal framework that governs trade unions' existence and activities. The last chapter analyses the use of instruments to advance their objectives in three case studies focusing on ČMKOS operations from 2003 to 2019.
