Use of Force in International Law

Abstract:

Cílem této práce je podat všeobecný přehled o zákazu použití síly podle č. 2 odst. 4 Charty OSN a jeho výjimkách. Členské státy OSN zakotvením čl. 2 odst. 4 neměly rozhodně v úmyslu zakázat použití síly absolutně, neboť nový systém měl zajistit hlavně bezpečnost a mír ve světě. Proto se tato práce věnuje též sebeobraně dle čl. 51 Charty OSN, analyzuje jednotlivé pojmy a předpoklady jejího uplatnění, a na různých případech demonstruje rozdílné přístupy k sebeobraně včetně více či méně sporných teorií a událostí.

Abstract:

The purpose of this thesis is to give general overview about the prohibition of the use of force according to the Art. 2 par. 4 of the UN Charter and about its exceptions. The UN member states did not embody this prohibition in the Charter as a complete prohibition of every use of force, since the new UN System should guarantee the safety and peace all over the world. Therefore this thesis deals with the right of self-defence according to the Art. 51 of the UN Charter as well, it analyses the particular terms used in this article and the conditions for its application, and demonstrates different approaches to the self-defence on the real cases including more or less controversial theories and events.
