Attorney profession ? attorney business and judicial position in the past and in the present

Abstract:

Účelem této diplomové práce je v co možná nejkomplexnější podobě pojednat o různých aspektech povolání advokáta. Na danou problematiku je nahlíženo z pohledu advokáta jako podnikatele, přičemž druhá část práce se zabývá otázkou justiční role advokáta, resp. nastiňuje advokátní činnost v různých typech soudního řízení. Pro celistvější obraz na činnost advokáta se autor zabývá samotným pojmem advokát a advokacie. V daných otázkách je komparováno i s historickými daty a dobovým pojetím advokacie a advokáta. Na otázku advokáta jako podnikatele a zároveň jeho justiční roli je nahlíženo nejen z pohledu právního, ale současně i z pohledu etického.

Abstract:

This thesis is intended to provide the most comprehensive possible discussion of various aspects of the legal profession. The subject matter is viewed from the aspect of an attorney-at-law as an entrepreneur, where the second part of the work is concerned with the role of an attorney in the judicial system and describes the activities of lawyers in various types of court proceedings. To provide a more comprehensive picture of the activities of an attorney-at-law, the author discussed the concepts of an attorney as such and of the legal profession, i.e. the Bar. In these areas, a comparison is given between historical data and the historical concept of the legal profession and attorney-at-law. In relation to the aspect of an attorney as an entrepreneur and his role in the judicial system, the subject matter is analysed, not only from a legal point of view, but also in terms of ethics.
