The Concept of Social Contract in 17th and in 20th century

Abstract:

Práce se zabývá problematikou společenských smluv v 17. a 20. století. Zaměřuje se na přirozenoprávní teorie u vybraných autorů. Je rozdělena na tři základní části. Úvodní část je věnována historickému přehledu přirozeného práva a snaží se ukázat vývoj a různé pohledy na tuto problematiku. V další části se práce zabývá přirozeným stavem a přirozeným právem u Thomase Hobbese, Johna Locka a Barucha Benedicta Spinozy. Zaměřuje se na výklad a na postavení přirozených práv u zmiňovaných autorů. Poslední část se soustředí na vývoj a pojetí přirozeného práva ve 20. století u autorů Johna Rawlse a Friedricha Augusta von Hayeka. Celá práce se soustředí na komparaci přirozeného práva v 17. a 20. století.

Abstract:

This thesis deals with the social contract in the 17th and 20th century. It is focused on theories of natural law in view of selected authors. It is divided into three basic structure parts. The first part is dedicated to a historical overview of natural law and tries to show the evolution of a variety of views of this topic. The next part deals with state of natural and natural law in view of three authors. They are Thomas Hobbes, John Locke and Baruch Benedict Spinoza. It is focused on the interpretation and the status of natural rights by these mentioned authors. Last part focuses on the evolution of a concept of natural law and its meaning in the 20th century by two authors. They are John Rawls and Friedrich August von Hayek. The whole thesis is focused on the comparison of natural law in the 17th and 20th century.
