Administration of Environmental Protection Fees by the Customs Administration of the Czech Republic

Abstract:

Bakalářská práce se věnuje problematice poplatků souvisejících s ochranou životního prostředí, které jsou součástí dělené správy a od 1. 1. 2006 jejich správu vykonává Celní správa ČR. V první části práce jsou poplatky podřazeny do systému nástrojů zajišťujících ochranu životního prostředí a jsou vymezeny jejich funkce. V další části se práce zabývá obecnou správou placení poplatků z pohledu celního úřadu jako správce daně. Stěžejní část práce se věnuje jednotlivým poplatkům se zaměřením na jejich výchozí právní úpravu, způsob vyměřování správními orgány, daňovou evidenci a nakládání s vybranými finančními prostředky. V návaznosti na identifikaci problematických míst ve správě poplatků jsou také navrženy možné změny v právní úpravě poplatků.

Abstract:

The Bachelor's thesis is dedicated to the problem of charges related to the protection of the environment, which are part of the split administration, and since the 1st January, 2006 they are administered by the Customs Administration of the Czech Republic. In the first part of the thesis, the charges are subordinated to the system of instruments that ensure protection of the environment, and their function is defined. In the next part, the thesis deals with the general administration of payment of charges from the perspective of the customs authority as the tax authority. The central part of the thesis is devoted to individual charges with the focus on their basic legal treatment, method of charging by the administration bodies, keeping tax records, and management of selected financial resources. Following the identification of issues in the administration of charges, possible changes in the legal treatment of charges are proposed.
