Abstract:

V práci se zabývám jednou z odvětvových zásad ovládajících oblast správního a soudního trestání. Účelem zásady zákazu reformace in peius je, aby účastník řízení nevzdal možnost podání opravného prostředku z důvodu obavy před možným zhoršením svého postavení. V této diplomové práci jsem se snažil ověřit hypotézu, že aplikace zásady má své opodstatnění v rámci trestního řízení, zatímco pro přestupkové a správní řízení je tato právní úprava spíše nadbytečná, zároveň nedokonalá a přinášející řadu aplikačních problémů. Jedním z hlavních závěrů této práce je, že aktuální úprava zásady zákazu reformace in peius v řízeních o přestupcích a jiných správních deliktech dostatečně neplní své cíle. Příčinou je skutečnost, že zásada zákazu reformace in peius nedopadá na řízení navazující na rozhodnutí odvolacího orgánu. Přikláním se k názoru, že pro řízení dle správního řádu a zákona o přestupcích není aplikace zásady zákazu reformace in peius nezbytná.

Abstract:

My theses deals with one of sectoral principles in sphere of administrative and judicial punishment. The purpose of the principle of the ban of reformation in peius is that the participant did not give up the possibility of an appeal because of fears of a possible deterioration their position. In this thesis, I tried to verify the hypothesis that the application of the principle is suitable for criminal proceedings, but for administrative punishment is rather unnecessary, imperfect and bringing many application problems. One of the main conclusions of this work is that current treatment of the principle of the ban of reformation in peius in administrative punishment does not guarantee its objectives. The reason is that the principle of the ban of reformation in peius does not impact following proceedings after the decision of the appeal authority. I support the change of legislation that for administrative punishment the principle of the ban of reformation in peius is not necessary.
