Constitutuion of the State Basic Law

Abstract:

The constitution represents the basic principles of each political system. It outlines the schemes of interference of the crucial authorities within the division of power into legislative, executive and judicial. The constitution is a basic normative regulation system of a respective country, it represents a system of legal acts with the highest force and a legal essence of the country. The constitution regulates respective country’s organisation base, its form and structure as well as the principles of the relations between the country and its inhabitants. On one hand, the constitution regulates the operation of the country, on the other hand it states the boundaries limiting the state powers. Modern countries derivate their legal systems from their constitutions, which have a status of a primary legal act. Modern countries‘ contributions have some attributes in common but they differ in the content due to the reason that each country has its own historical background.

Abstract:

Ústava predstavuje základný kameň každého politického systému. Načrtáva schémy vzájomného pôsobenia rozhodujúcich orgánov v rámci delenia moci na zákonodarnú, výkonnú a súdnu. Ústavou rozumieme normatívny základný poriadok štátu, ako systém noriem najvyššej právnej sily, ako právny základ štátu. Ústava upravuje základy organizácie štátu, jeho formu a štruktúru i zásady vzťahov medzi štátom a občanmi. Ústava na jednej strane reguluje fungovanie štátu, na strane druhej spĺňa požiadavky na obmedzovanie štátnej moci. Moderné štáty odvodzujú svoj právny poriadok od svoje ústavy, ktorej priznávajú postavenie základného zákona. Ústavy moderných štátov majú spoločné hlavné znaky, ale ich obsah nie je úplne rovnaký, pretože každý štát má iné historické skúsenosti.
