The Evolution of the Reproach Proceedings in the Case-law Context

Abstract:

Práce je zaměřena na úskalí postupu v daňovém řízení s ohledem na zpětnou vazbu poskytovanou správním soudnictvím. Vzhledem ke zvolenému tématu vychází práce, kromě několika knižních zdrojů a právního řádu České republiky, zejména z rozsudků Nejvyššího správního soudu. Cílem diplomové práce je popsat problematiku volby vhodného postupu v daňovém řízení s ohledem na následky z této volby plynoucí. Práce by měla poukázat zejména na složitou pozici správce daně při jeho argumentaci v souladu s platným právním zázemím a na některé odlišnosti ve výkladu práva správním soudem.

Abstract:

This thesis is focused on the pitfalls of the procedure in the tax proceedings with regard to the feedback provided by the administrative judiciary. Due to the chosen topic, this thesis is based on several book sources and in particular from the judgments of the Supreme Administrative Court. The aim of the diploma thesis is to describe the issue of the choice of the appropriate procedure in the tax proceedings with regard to the consequences of this choice. This thesis should point out in particular the complicated position the tax administrator's case in his argumentation in accordance with the legal background in force and some differences in the interpretation of the law by the administrative court.
