Remuneration for the dependent work

Abstract:

Diplomová práce shrnuje současnou českou právní úpravu v oblasti odměňování závislé práce, kterou dále rozvádí v kontextu relevantních judikátů, které ukotvují a doplňují současný výklad této právní úpravy. Pro lepší pochopení dané problematiky tato práce obsahuje i několik praktických příkladů s řešením. Další částí práce je exkurz do německé právní úpravy se zaměřením na rozdíly mezi českou a německou úpravou, a to konkrétně v oblasti týkající se odměňování zaměstnanců ve veřejné správě, zejména pak s ohledem na motivační a výkonové složky v jejich odměňování. V samotném závěru práce pak její autor nabízí návrh dílčích změn současného českého systému odměňování zaměstnanců platem v kontextu s německou právní úpravou, a to toliko jako příspěvek do eventuální debaty de lege ferenda. Formu této práce lze označit jako čistě teoretickou, neboť její autor využívá především metodu deskriptivní, analytickou a komparativní. Hlavními prameny, ze kterých práce čerpá, jsou platné právní normy, odborné publikace a relevantní judikatura.

Abstract:

The diploma thesis summarizes the current Czech legislation in the field of remuneration of dependent work, which it further elaborates in the context of relevant case law, which anchor and supplement the current interpretation of this legislation. For a better understanding of the issue, this thesis also contains several practical examples with solutions. Another part of the work is a digression into German legislation with the focus on the differences between the Czech and German legislation, specifically in the field of remuneration of employees in public administration with regard to the motivational and performance components in their remuneration. At the very end of the work, the author offers a proposal for partial changes to the current Czech system of remuneration of employees in the context of German legislation, as a contribution to a possible debate de lege ferenda. The form of this work can be described as purely theoretical, as its author uses mainly descriptive, analytical and comparative methods. The main sources from which the thesis draws are valid legal norms, professional publications and relevant case law.
