Derogations from the Prohibitions of Protected Species Subject to the Game Management Act

Abstract:

Předkládaná bakalářská práce se zabývá otázkou právní úpravy výjimek z ochrany ohrožených druhů živočichů, kteří jsou současně zvěří. Významná část práce je věnována relevantním národním i mezinárodním pramenům práva upravujícím ochranu zvláště chráněných druhů živočichů a výkon práva myslivosti. Zvláštní kapitoly jsou věnovány vlastnímu procesu povolování výjimek z ochrany ohrožených druhů živočichů, respektive stěžejním zákonným předpisům v dané oblasti, zákonu č. 114/1992 Sb., o ochraně přírody a krajiny a zákonu č. 449/2001 Sb., o myslivosti. Cíle práce spočívajícího v identifikaci střetů výše uvedených zákonů je dosaženo zejména na základě dvou případů reálných životních situací. Za účelem odstranění zjištěných nedostatků jsou u každého příkladu navrženy změny de lege ferenda.

Abstract:

The presented bachelor paper deals with the issue of legal regulation of exceptions from the protection of endangered species of animals that are seen also as game. A significant part of the paper is devoted to relevant national and international sources of law which regulate protection of especially protected/endangered animal species as well as the administration of game management rights. Specific chapters are devoted to the actual process of granting exemptions from the protection of endangered animal species, respectively to fundamental legal regulations in that given area, in particular Act No. 114/1992 Coll., on nature and landscape protection and Act No. 449/2001 Coll., on game management. The main goal of the paper is reached by identification of conflicts between the Acts mentioned above using principally two cases of real life situations. In order to eliminate the already identified shortcomings, de lege ferenda changes are proposed for each situation example.
