Rules of Division of the Burden of Proof

Abstract:

Důkazní břemeno je považováno za páteř civilního procesu, proto je tento pojem a pojmy s ním související na začátku práce vymezen. Cílem práce je objasnit problematiku pravidel dělení důkazního břemena. Práce se zabývá právní povahou důkazního břemena, vymezuje důkazní břemeno na subjektivní a objektivní, teoreticky i prakticky poukazuje na teorii analýzy norem a pro ucelený náhled na tuto problematiku, podrobuje kritickému zkoumání starší teorie a za pomoci substancování břemena vyvrací jednu z těchto teorií. V závěru práce jsou uvedena vhodná řešení de lege ferenda.

Abstract:

The burden of proof is considered to be the backbone of civil trial. That´s why term is defined in the very beginning of the thesis. The aim of the thesis is to clarify procedures and rules when structuring burden of proof. Thesis deals with the legal nature of the burden of the proof, defines subjective and objective burden of proof, points to both theoretical and practical theories of norm analysis and to comprehensive view to this topic. Older theories are subject of critical examination and one of them is disproved using substantiation of the burden. Suitable de lege ferenda solutions are mentioned in the conclusion.
