Health insurance and legal position of person insured

Abstract:

Ve své diplomové práci se budu nejprve věnovat systémům zdravotního pojištění a vývoji zdravotního pojištění na území České republiky, definuji základní pojmy. Hlavní tématem diplomové práce bude definování nároku pojištěnce na poskytnutí hrazených zdravotních služeb a vymahatelnost tohoto nároku. Dále se zaměřím zejména na právní postavení pojištěnce v systému zdravotní pojištění. Základním právem pojištěnce je ústavní právo na bezplatnou zdravotní péči a na zdravotní pomůcky za podmínek, které stanoví zákon. Toto právo vzniká pojištěnci právě na základě veřejného zdravotního pojištění. A zde nastává hlavní otázka, která se bude prolínat celou mojí diplomovou prací a kterou považuji za zcela klíčovou: jak je zákonem stanoven nárok pojištěnce na poskytnutí bezplatné zdravotní péče v kontextu objemu dostupných finančních prostředků a je tento nárok skutečně vymahatelný? Doufám, že se mi podaří na tuto otázku nalézt alespoň částečnou odpověď.

Abstract:

In my thesis, I will focus on health insurance systems and the development of health insurance in the Czech Republic first and then I will define the basic concepts. The main goal of the thesis is to define the claim of the insured person to the public paid health service provision and its enforceability. Then, I will focus in particular on the legal status of the insured person in health insurance system. The basic right of the insured person is constitutional right to free health care and medical aids under the conditions provided by law. This insured person´s right results from public health insurance. And here comes the main question that will be running through all my thesis and I think is absolutely crucial: how law defines the right of the insured person for free health care in the context of the volume of funds available and is this claim actually enforceable? I hope I can find at least a partial answer to this question.
