Analysis of the position of participants in insolvency proceedings and inter-regional differences in structurally affected regions

Abstract:

Tato bakalářská práce se zabývá postavením účastníků insolvenčního řízení v České republice se zaměřením na vybrané regiony. Cílem práce je analyzovat faktory ovlivňující počet insolvenčních řízení v jednotlivých krajích a porovnat jejich postavení v insolvenčním procesu. Teoretická část práce se zaměřuje na základní pojmy insolvenčního práva, postavení účastníků insolvenčního řízení a legislativní rámec v České republice. Analytická část práce obsahuje analýzu dat získaných z veřejně dostupných statistik a je doplněna kvalitativní metodou řízených rozhovorů s náhodně vybranými účastníky řízení, která jsou použita k porovnání situace v Karlovarském, Ústeckém a Moravskoslezském kraji. Výsledky analýzy ukazují rozdílné charakteristiky, ale faktory ovlivňující počet insolvenčních řízení v jednotlivých krajích se velmi podobají. Práce přispívá k lepšímu porozumění dynamiky insolvenčních procesů v regionech České republiky a může sloužit jako podklad pro další výzkum v oblasti insolvenčního práva a regionálního rozvoje.

Abstract:

This bachelor´s thesis deals with the position of participants in insolvency proceedings in the Czech Republic with a focus on selected regions. The aim of the work is to analyze the factors influencing the number of insolvency proceedings in individual regions and to compare their position in the insolvency process. The theoretical part of the thesis focuses on the basic concepts of insolvency law, the position of participants in insolvency proceedings and the legislative framework in the Czech Republic. The analytical part of the thesis contains an analysis of data obtained from publicly available statistics and is supplemented by a qualitative method of controlled interviews with randomly selected participants in the proceedings, which are used to compare the situation in the Karlovy Vary, Ústí and Moravian-Silesian regions. The results of the analysis show different characteristics, but the factors influencing the number of insolvency proceedings in individual regions are very similar. The thesis contributes to a better understanding of the dynamics of insolvency processes in the regions of the Czech Republic and can serve as a basis for further research in the field of insolvency law and regional development.
