Abstract:

Tato diplomová práce se věnuje tématu zabezpečovací detence. Práce je členěna do sedmi kapitol. V úvodu je čtenáři nastíněna oblast zájmu této diplomové práce. Primárním cílem první kapitoly je komplexně shrnout zejména důvody vedoucí k zavedení tohoto institutu do praxe. Druhá kapitola popisuje obligatorní i fakultativní podmínky uložení zabezpečovací detence. Třetí kapitola této práce je věnována zabezpečovací detenci a trestu odnětí svobody s uvedením praktického případu uložení tohoto institutu vedle trestu. Čtvrtá část této diplomové práce popisuje samotný výkon zabezpečovací detence včetně situací, kdy je ochranné léčení změněno na zabezpečovací detenci a naopak. Pátá kapitola popisuje detenční zařízení v České republice. V šesté kapitole jsou uvedené základní statistické údaje o výkonu zabezpečovací detence. Vzhledem ke skutečnosti, že je tato diplomová práce veskrze teoreticky zaměřená, je sedmá kapitola této práce věnována vybraným otázkám týkajících se zabezpečovací detence z pohledu odborného pracovníka působícího v Ústavu pro výkon zabezpečovací detence v Brně, spolu s uvedením některých zjištěných nedostatků zabezpečovací detence, na které jsem v průběhu psaní této práce narazila.

Abstract:

This diploma thesis deals with the topic of security detention. The work is divided into seven chapters. The introduction outlines the area of interest of this diploma thesis. The primary goal of the first chapter is to comprehensively summarize the reasons leading to the implementation of this institute in practice. The second chapter describes the obligatory and optional conditions of imposing security detention. The third chapter of this work is devoted to pre - trial detention and imprisonment with an indication of the practical case of imposing this institute in addition to punishment. The fourth part of this diploma thesis describes the performance of security detention, including situations where protective treatment is changed to security detention and vice versa. The fifth chapter describes detention facilities in the Czech Republic. The sixth chapter presents basic statistical data on the performance of security detention. Due to the fact that this diploma thesis is entirely theoretically focused, the seventh chapter of this thesis is devoted to selected issues related to security detention from the perspective of a specialist working at the Institute for Security Detention in Brno and the identified shortcomings of security detention are presented, which I came across during the writing of this thesis.
