Abstract:

Předkládaná diplomová práce nesoucí název „Koncept ústavního patriotismu a překážky jeho naplnění v perspektivě Evropské unie“, si klade několik cílů. Nejprve jde o charakteristiku historických pojetí ústavního patriotismu, konceptu pocházejícímu od německých politických a sociálních teoretiků Sternbergera a Habermase. Reflexe jejich myšlenek je vyložena za pomoci moderních, mladších autorů. Následně dochází k odlišení a charakteristice současné Obecné teorie ústavního patriotismu pocházející od politického teoretika Jana-Wernera Müllera. Po analýze jeho textů je abstrahována esence Obecné teorie ústavního patriotismu tak, abychom mohli zodpovědět dvě stěžejní otázky. Totiž zaprvé, tu po hypotetické možnosti, že by mohl vzniknout ústavní patriotismus EU. A po konfrontaci s empirickou realitou a za použití základních poznávacích znaků Obecné teorie ústavního patriotismu jsou také hledána možná vysvětlení současného neuspokojivého stavu. Toto hledání však není samoúčelné, ale má formátovat další diskusi o možných postupech k ústavně-patriotické praxi EU, která může mít potenciál krotit jak výstřelky nacionálního liberalismu, tak také klasických forem patriotismu, s cílem přinést stabilitu ústavně-demokratické politě.

Abstract:

This master thesis bearing the title „The Concept of Constitutional patriotism and the Obstacles of its Fulfilment in the EU Perspective“, has more than one goal. Firstly, it aims at the characteristics of historical conceptions stemming from German political and social theorists Dolf Sternberger and Jürgen Habermas. Reflexions of their thoughts and conceptions are provided by younger authors dealing with the same topic. Subsequently, this paper deals with distinct, contemporary General theory of constitutional patriotism developed by Jan-Werner Müller. Following analysis of his writings, the very same essence of the General theory of constitutional patriotism is abstracted with the intention to answer two fundamental questions. Firstly, we are asking, whether there is a hypothetical chance, that constitutional patriotism of the EU will evolve. Being confronted with empirical reality and using the basic features of the theory under review, we are trying to identify some elementary explanations of barriers to creation of constitutional patriotism of the EU. This is not just a self-serving exercise, but rather an attempt to structure the debate for future discussion about the subject with a clear potential in taming the extremes of both: national liberalism as well of classical patriotism, with only one ultimate goal in securing stability of constitutional-democratic polity.
