Conception and Sanction of Concurrence of Crimes in Czech Penal Code

Abstract:

Cílem diplomové práce je objasnění toho, jak je pojem souběhu trestných činů chápán trestněprávní teorií, soudní praxí a jak je upraven současnou právní úpravou, jaké má souběh trestných činů druhy, čím se od sebe tyto druhy souběhu trestných činů odlišují, z jakých důvodů se o souběh trestných činů nejedná, jaké má souběh trestných činů účinky, jakým způsobem je možné souběh trestných činů postihovat podle právní vědy a jak je souběh trestných činů postihován podle současné úpravy v České republice a pro srovnání také ve Spolkové republice Německo a Slovenské republice. V diplomové práci jsem nejprve osvětlila pojem souběhu trestných činů definicí tohoto pojmu za pomoci poznatků trestněprávní vědy a soudních rozhodnutí, což napomohlo při odlišení souběhu trestných činů od ostatních druhů mnohosti trestné činnosti. Dále jsem se zabývala jednotlivými druhy souběhu trestných činů, protože jejich rozlišení je potřebné pro posouzení závažnosti jednotlivých druhů souběhu trestných činů, neboť na základě jejich nebezpečnosti pro společnost jsou jednotlivé druhy souběhu trestné činnosti postihovány podle odlišných zásad trestání souběhu trestných činů. Pro rozlišení jednotlivých druhů souběhu trestných činů jsem nejprve musela vymezit, co je skutek a jednota skutku. Jelikož mohou nastat také důvody vylučující souběh trestných činů, objasnila jsem, ve kterých případech k této situaci může dojít, neboť pak se neuplatňuje postih podle zásad trestání za sbíhající se trestnou činnost, protože se o souběh trestných činů nejedná, přestože by se tomu tak mohlo zdát. Souběh trestných činů může mít účinky v trestním právu hmotném i trestním právu procesním. Objasnění promlčení trestných činů, jakožto hmotněprávního účinku, mi umožnilo posoudit, kdy je ještě možné za sbíhající se trestnou činnost uložit trest podle zásad trestání souběhu trestných činů a kdy již kvůli uběhnutí promlčení lhůty u jednoho sbíhajícího trestného činu, není možné druhý z nich postihnout za souběh trestných činů, ale jen toliko za trestný čin jediný. Rozlišení, jestli bylo konáno společné řízení, anebo byla nějaká trestná činnost vyloučena ze společného řízení, jakožto procesněprávní účinek souběhu trestných činů, mi pomohlo určit, jestli bude souběh trestných činů postižen trestem úhrnným nebo souhrnným. Pohled na postih souběhu trestných činů z hlediska právní teorie ukázal výhody a nevýhody jednotlivých zásad trestání souběhu zejména měly-li by se uplatnit samostatně bez jejich zkombinování. Porovnáním současné a původní právní úpravy potrestání souběhu trestných činů jsem zjistila, že současná právní úprava vychází z původní, ke které se přidala možnost uplatnění zásady asperační formou zpřísnění v případě vícečinného souběhu většího počtu trestných činů. Objasnila jsem, kdy je podle současné právní úpravy postihu souběhu trestných činů ukládán úhrnný a kdy souhrnný trest, jakým způsobem jsou tyto tresty ukládány a kdy je upuštěno od uložení trestu. Srovnáním současné české a německé právní úpravy jsem zjistila, že česká úprava vychází z úpravy německé, kdy obě shodně kombinují při postihu souběhu trestných činů zásadu absorpční, kumulační a asperační. Porovnáním se současnou slovenskou úpravou, která měla s českou společný historický vývoj, jsem nalezla některé odlišnosti při uplatnění zásady asperační při postihu vícečinného souběhu trestných činů. Abstract:

The aim of the present thesis is to investigate concurrence of crimes from the criminal law theory viewpoint and from the judicial practise viewpoint. The paper further investigates concurrence of crimes under present Czech legislation, types of concurrence of crimes and the differences between them, insufficient grounds for concurrence of crimes, effects of concurrence of crimes and ways of studying concurrence of crimes according to legal theory. Finally, the thesis investigates concurrence of crimes under present Czech legislation and compares it to the present German and Slovak legislation. First, I clarified concurrence of crimes as a term defined by the criminal law theory and by past court’s decisions. This helped me distinguish concurrence of crimes from other types of multiple offences. Next, I studied types of concurrence of crimes. The categorization enables evaluating the gravity of separate types of concurrence of crimes. Every type is punished according to different rules depending on the degree of danger it poses for society. To distinguish separate types of concurrence of crimes, it was necessary to define the terms act and act unity. As there may arise cases that do not qualify as concurrence of crimes, I studied the relevant circumstances. These cases are not punished as concurrence of crimes although they may seem fitting to the category. Concurrence of crimes may be applied to substantive criminal law as well as to criminal procedure. I studied statute of limitations from the substantive criminal law viewpoint to identify cases in which concurrence of crimes may be punished according to the relevant penal code and cases which do not qualify as concurrence of crimes because the subsequent offence occurred after the lapse of time for the offender to be prosecuted. In the latter case, the second offence is treated as having no relation to the previous one whatsoever. I also studied procedural effects of concurrence of crimes. To decide whether concurrence of crimes will be punished as a multiple sentence or an accumulative sentence, it was necessary to determine whether all of the offences were taken into account in the judicial proceedings or whether some of the offences were excluded. Studying sentences for concurrence of crimes from the legal theory viewpoint pointed to advantages and disadvantages of different punishment rules especially when applying one rule excludes applying another one at the same time. When comparing the present-day Czech legislation concerning concurrence of crimes with past legislation, I found out that the present legislation is based on the past one. The main difference is the possibility of stricter punishment in case of concurrence of multiple crimes. By referring to relevant acts, I studied circumstances when concurrence of crimes is punished as a multiple sentence and when it is punished as an accumulative sentence as well as cases when the punishment is dropped. By comparing the present-day Czech legislation with the German one, I found out that the former is based on the latter while both combine the absorption, cumulation and asperity punishment rules. Historically, the Slovak legislation evolved with the Czech one. By comparing the present legislations of both countries, I found certain differences in asperity punishment rules applied to concurrence of multiple crimes. I like to think that the main contribution of the present thesis is the thorough examination of concurrence of crimes and its punishment as well as the comparison of recent changes in legislation concerning concurrence of crimes and its punishment.
