Alternative Punishents to Uniconditional Imprisonment a Narrower Context.

Abstract:

Předmětem této práce je ucelené pojednání o alternativních trestech v českém trestním právu, zejména pak o alternativních trestech k nepodmíněnému trestu odnětí svobody v tzv. užším pojetí. Práce se zaměřuje na hmotně právní úpravu trestu podmíněného odsouzení a obecně prospěšných prací, neboť se jedná o tresty, které v sobě zahrnují odborné psychosociální vedení a kontrolu pachatele zajišťované specializovaným orgánem- Probační a mediační službou. O vzniku, významu, úkolech a činnosti Probační a mediační služby pojednává samostatná kapitola rigorózní práce. Další část této práce pojednává o problematice alternativních trestů ukládaných mladistvým. Myšlenka alternativního trestání koncepčně vychází z principů tzv. restorativní justice. Bližší přiblížení a vyjasnění pojmu restorativní justice je obsaženo v samostatné části této práce. V práci je věnován prostor i nové kodifikaci trestního práva, která je v současné době projednávána v Poslanecké sněmovně Parlamentu České republiky. Práce obsahuje i stručný přehled dvou zahraničních úprav, slovenské a britské, se zaměřením na úpravu alternativních trestů v užším pojetí. V závěru jsou nastíněny možné návrhy na změnu hmotně právní úpravy alternativních trestů v užším pojetí de lege ferenda. Tato rigorózní práce je založena zejména na studiu tuzemské a zahraniční literatury, právních předpisů, publikované judikatury soudů, studium a analýza publikovaných názorů, denního tisku a internetových zdrojů. V práci byly použity následující metody řešení: monografická, induktivní, deduktivní, přímá, nepřímá, historická, komparativní, analýza, syntéza a interpretace.

Abstract:

The main goal of my contribution is an integral compilation of an overview regarding alternative punishment in Czech criminal law, particularly alternative punishments to unconditional imprisonment in a narrower context. I focus materially on the legal arrangements for crime probational supervision and community services in regard to punishment itself that contains professional psycho-social management and handling of the perpetrator provided by specialised authorities arranged on the basis of Act No. 257/2000 Coll., on Probation and Mediation Service. I discuss the establishment, significance, tasks and activities of Probation and Medation Service in separate sub-chapters of this work. Differences between juvenile and adult perpetrators, which are derived from the generally lower comprehension and moral development of juveniles, in addition to special arrangements for conditions in establishing criminal responsibility and special sanction arrangements, are justified despite alternative sanctions established for juveniles. The issue itself of alternative punishment arranged for juveniles by special law is part of an independent section. The thought of alternative punishment is derived conceptually from the principles of so-called restorative justice, which in principle offers an alternative framework for considering criminal behaviour. It is understood as an effort to rehabilitate from a criminal act through an interrupted or endangered system of protected values and social relationships. I am therefore attempting a more detailed approximation and clarification of the concept of restorative justice. In my work, I could not omit the new codification of the criminal code, which currently is being discussed in Parliament. I am attempting to approximate a brief overview of two foreign modifications- Slovak and British- through additional viewpoints and options for using alternative punishment, which could be a positive inspiration for Czech legal arrangements. In conclusion, I assess a valid system of materially arrangement of alternative punishments in a narrower context in the Czech Republic and with using knowledge obtained from foreign legal arrangements, with which I have become acquainted during the completion of my work, I define negative elements in it, summarize my perceptions, suggestions and give my own proposals de lege ferenda. During my work I have employed the following methods for this solution: monographic, inductive, deductive, direct, indirect, historical and comparative methods, analysis, synthesis and interpretation.
