Abstract:

Diplomová práce je zaměřena na ochranné známky, kdy v hospodářské soutěži dochází k nekalosoutěžnímu jednání. Diplomová práce je rozdělena do 9 kapitol, které zahrnují subkapitoly. Kapitoly 1 až 8 se zaměřují na teoretickou část práce a kapitola 9 zahrnuje analytickou část. V úvodních kapitolách je prostor vymezen k představení ochranných známek a jejich druhů, popsána je právní úprava jak z pohledu českého práva, tak i práva mezinárodního. Dalším tématem, kterému se práce věnuje je nekalá soutěž a popsány jsou i některé skutkové podstaty nekalé soutěže, který mají přímý dopad na spotřebitele. V dalších kapitolách teoretické části je popsán problém padělků s navazujícími podkapitolami, v nichž jsou popsány možnosti trestů, které mohou být uděleny výrobcům a distributorům padělků. Konec teoretické části diplomové práce je věnován možnostem, na základě kterých může majitel ochranných známek vymáhat svá práva. Pro lepší pochopení daného problému, jsou v jednotlivých kapitolách uvedeny jako příklady analýzy judikatur. Práce se zaměřuje na ochranné známky z pohledu spotřebitele, proto analytická část obsahuje vyhodnocení dotazníků, které byly předloženy průměrným spotřebitelům. Následně jsou jednotlivé odpovědi zpracovány a popsány. Cílem práce je zhodnotit celkový pohled spotřebitele na ochranné známky a dále i jejich chování v případě, když se jedná o porušení práv z této ochrany.

Abstract:

The diploma thesis is focused on trademarks, when unfair behavior occurs in economic competition. The diploma thesis is divided into 9 chapters, which include subchapters. Chapters 1 to 8 focus on the theoretical part of the work, and chapter 9 includes the analytical part. In the introductory chapters, space is defined for the presentation of trademarks and their types, the legal regulations are described both from the point of view of Czech law and international law. Another topic that the work deals with is unfair competition, and some facts of unfair competition that have a direct impact on consumers are also described. In other chapters of the theoretical part, the problem of counterfeits is described with subsequent sub-chapters, in which the possibilities of punishments that can be awarded to manufacturers and distributors of counterfeits are described. The end of the theoretical part of the diploma thesis is devoted to the possibilities of how the trademark owner can enforce his rights. For a better understanding of the given problem, they are presented in individual chapters as examples of case law analysis. The work focuses on trademarks from the consumer's point of view; therefore, the analytical part contains the evaluation of questionnaires that were submitted to average consumers. Subsequently, the individual answers are processed and described. The aim of the work is to evaluate the consumer's overall view of trademarks and, further, their behavior in the event of a violation of rights from this protection.
