Ethical Code of the Police of the Czech Republic (offenses and misdemeanors)

Abstract:

Tato bakalářská práce popisuje vznik, vývoj etických kodexů a průběh jeho geneze na našem území. V první části jsou definovány nejdůležitější pojmy. Dále zkoumá problematiku uplatňování etického kodexu v prostředí současné Policie České republiky, její historický vývoj od dob četnictva přes jednotlivá historická období po současnost. Nejsou opomenuty také historické prameny vzniku etických kodexů od přijetí dokumentu {\clqq}Kodex pro chování osob odpovědných za provádění zákonů`` schváleným Valným shromážděním Spojených národů rezolucí č. 34/169 z roku 1979 po Rozkaz Policejního prezidenta č. 1/2005 Etický kodex Policie ČR. Popisuje, charakterizuje edukaci etického kodexu u Policie České republiky. Poukazuje na specifika úpravy jednání, chování a vystupování policistů od dob četnictva po současnost, což je demonstrováno na služebních přísahách příslušníků policie, Sboru národní bezpečnosti a četnictva v jednotlivých historických souvislostech. V základních rysech jsem se pokusil osvětlit pojem, podstatu, význam a funkci etického kodexu v současné policii. Provedený výzkum zmapoval vědomosti, přístupy a sociální souvislosti s chováním, jednáním nebo vystupováním policistů a porovnal tyto zjištění s obecně převzatými hypotézami týkající se tohoto jednání policistů. Také byl výzkum zaměřen na sociální souvislosti, vliv sociálního postavení a ekonomické situace rodiny na možné excesy v etickém chování a profesionalitě policistů. Na základě teoretických zjištění a výzkumu v závěru jsou navrženy opatření a to nejen systémová, ale i praktický opatření na základních územních celcích k zlepšení situace.

Abstract:

This thesis describes the origin, development of ethical codes and progress of their genesis on our territory. The first part contains the definition of the most important terms. It also explores the issue of application of the ethical code within the contemporary Police Department of the Czech Republic, its historical development since the gendarme times through particular historical periods up to present. There are also historical materials related to the origin of ethical codes starting with the document {\clqq}Code of behavior of officers responsible for enforcing the law`` passed by the General Assembly of the United Nations Organization in the resolution No. 34/169 in 1979 up to the Direction of the Police President No. 1/2005 Ethical Code of the Police Department of the Czech Republic. It describes, characterizes the instruction of the ethical code within the Police Department of the Czech Republic. It points out the specifics of the adaptation of acting, behavior and manners of the police since the gendarme times up to present which is shown on the official oaths of the members of the police department, the National Security Department and the gendarmes in the different historical situations. I tried to explain the concept, principle, meaning and function of the ethical code in the contemporary police department. The practical research mapped the knowledge, attitudes and social context of the behavior, acting or manners of the police, and compared these findings with universally accepted hypotheses concerning this behavior of the police. Also, the research focused on the social context, the influence of the social status and economic situation of the family on the potential excesses in the ethical and professional behavior of the police. Based on the theoretical findings and research, the thesis concludes with a proposal of measures, not only systematic, but also practical measures in the regional sections aimed at improving the situation.
