Abstract:

Tato bakalářská práce pojednává o významu intuice v rozhodovacích procesech soudců před vynesením rozsudku. Práce rozebírá historické právní teorie, které se věnovaly rozhodovací činnosti soudců založené na sledování mimoprávních faktorů, kterými se tato činnost řídí, zejména intuicí soudců. Popis právních teorií se zaměřuje především na Školu volného práva a Americký právní realismus. Další část práce rozebírá význam intuice z mnoha směrů, blíže se pak rozebírá aplikace intuice v psychologii a role intuice v právu, která ovlivňuje rozhodovací procesy v nevědomé fázi. V poslední části se zabýváme analýzou rozhodnutí Ústavního soudu, při kolizi dvou základních práv, a to konkrétně svobody projevu proti právu na ochranu osobnosti. V poslední kapitole si teoreticky vymezíme Ústavní soud České republiky, Test proporcionality. Závěrem se věnujeme jednotlivým nálezům Ústavního soudu.

Abstract:

The bachelor thesis shall be reflecting upon the importance of intuition in the decision-making process which precedes passing the judgement stated by the judge. The thesis introduces historical legal theories that consider the decision-making procedure and follow other-non legal factors that control this process, especially the judge’s intuition. The description of legal theories mainly focuses on The Free Law School and American Legal realism. Part two is dedicated to the importance of intuition. It shall therefore examine the application of intuition in psychology, the role of intuition in law and its influence in the unconscious phase of the decision-making procedure. The next part emphasizes the decision of the Constitutional court made in collision of two fundamental rights, the freedom of expression and personal rights. This chapter defines the Constitutional court of the Czech Republic, Proportionality test. The final part puts special stress on individual findings of the Constitutional court.
