The position of the industrial property office in trademark proceedings

Abstract:

Bakalářská práce pojednává o Úřadu průmyslového vlastnictví a jeho pravomoci a působnosti v oblasti průmyslových práv, zejména v oblasti ochranných známek. Cílem práce je vymezit Úřad průmyslového vlastnictví jako ústřední správní orgán v oblasti ochrany práv z průmyslového vlastnictví. Práce se zaměřuje na postavení Úřadu průmyslového vlastnictví v řízení o ochranných známkách. Začátek práce stručně vymezuje ostatní průmyslová práva, dále už je větší pozornost věnována ochranné známce. Práce dále zahrnuje popis současného postavení Úřadu ve statní správě a jeho historického vývoje. Závěrečnou kapitolu tvoří rozbor databáze spravovanou Úřadem, konkrétně zasazení jedné ochranné známky z databáze do historického kontextu známkového práva a komparace databáze Úřadu s registrem ochranných známek Úřadu průmyslového vlastnictví Slovenské republiky.

Abstract:

The bachelor thesis deals with the Industrial Property Office and its powers and competence in the field of industrial rights, especially in the field of trademarks. The aim of the thesis is to define the Industrial Property Office as the central administrative authority in the field of protection of industrial property rights. The thesis focuses on the position of the Industrial Property Office in trademark proceedings. The beginning of the thesis briefly defines other industrial rights, then more attention is paid to trademarks. The work also includes a description of the current position of the Office in the state administration and its historical development. The final chapter consists of an analysis of the database administered by the Office, specifically placing one trademark from the database in the historical context of trademark law and comparing the Office's database with the trademark register of the Industrial Property Office of the Slovak Republic.
