Duty of care in the case law and its applicability after the new Civil Code
Abstract:
Cílem práce bylo zhodnotit použitelnost dosavadní judikatury péče řádného hospodáře v nové právní úpravě. V úvodu bakalářské práce je obecně vymezen zákonný rámec pojmu péče řádného hospodáře. V dalších částech je prováděna analýza a klasifikace použitelnosti významných rozhodnutí související s péčí řádného hospodáře. Abstract:
The aim of this thesis is to judge the applicability of the present case-law of duty of care in the new Civil Code. The introduction defines the term duty of care, and the latter parts consist of analysis and classification of the applicability of significant decrees connected with duty of care. The conclusion is that the present case-law in the new Civil Code is still applicable.
