Abstract:

Rychlost a efektivita řešení sporů je zřejmě hlavním důvodem, proč smluvní strany v mnoha případech dávají přednost rozhodčímu řízení před řízením soudním, a to obzvláště v oblasti mezinárodního hospodářského styku. Tato diplomová práce se zaměřuje nejen na posouzení naplnění takových očekávání, ale také na kritické zhodnocení předností a nedostatků mezinárodní obchodní arbitráže a oprávněnosti jeho výsadního místa při řešení mezinárodních sporů. Jako prostředek posouzení byla zvolena především analýza způsobu řešení sporů v rozhodčím řízení v mezinárodním obchodním styku zaměřená na porovnání řešení obdobných sporů v soudním řízení. Výsledná zjištění jsou shrnuta v závěru práce.

Abstract:

The speed and effectiveness of dispute resolution is probably the main reason why the parties are in many cases before the arbitration, particularly in the field of international economic relations. This thesis focuses, not only on assessment of the fulfilment of such expectations, but, also on the critical evaluation of the strengths and weaknesses of the international commercial arbitration and his privileged place in resolving international disputes. This evaluation is being done on the basis of analysis. Analysis is the assessment tool used to compare and contrast strengths and weaknesses between the international arbitration process and the judicial process. The findings are summarised in the conclusion.
