Abstract:

Disertační práce se zabývá interpretací práva, která je chápána jakožto komunikační akt. Práce nabízí některé interpretační možnosti založené na komunikativním konceptu práva. Z tohoto pohledu práce analyzuje mimo jiné textualismus, intencionalismus a právní analogii. Disertační práce ukazuje, jakým způsobem komunikace v komunitě reflektuje vytváření významu, přičemž text je vnímán jako až výsledek této komunikace, který podléhá kulturním a subjektivním determinantám. Interpretace autoritativních interpretů představuje potom vlivný element právní interpretace. Tato práce se taktéž zabývá nadcházejícími změnami v interpretaci spojené s novým občanským zákoníkem. Tyto změny se týkají nejen kritérií v rámci procesu interpretace a aplikace práva, ale i samotné role interpretace v systému práva.

Abstract:

The thesis focuses on the interpretation of law which is conceptualised as a communicative act. The thesis offers some interpretative possibilities based on the communicative concept of law. In its view, the thesis analyses (among others) textualism, intentionalism, or legal analogy. This thesis shows, in what ways the communication in the community reflect the production of the meaning, since the text has been understood as a result of the communication and the product of cultural and subjective determination. Thus the interpretation of authoritative interpreters constitutes the influential element of the law interpretation. Furthermore, this thesis focuses on coming changes in the interpretation associated with the new Civil Code. These changes are not only related to the criteria within the process of interpretation and application of law, but also the role of the interpretation in the system of law.
