The Constitutional Order of the Czech Republic and importace for strengthening democracy in the Czech Republic

Abstract:

Úkolem této práce je posoudit, zda ústavní pořádek ČR slouží jako nástroj zachování zásad demokratického státu založeného na základních právech občana. V rámci tohoto posouzení je nahlédnuto do historických souvislostí vzniku ústav a to nejen z pohledu velmi pestrého ústavního vývoje České republiky či bývalé Československé republiky. Rozebrány jsou nejstěžejnější modely právních kultur světa, zodpovězeny otázky vlivu zahraničních ústavních systémů. Ústavní pořádek je také posouzen z hlediska umístění v pyramidě právních norem, je popsán legislativní proces přijímání právních norem včetně jeho institucionální zajištění. Postavení obou komor parlamentu ČR, úloha vlády a prezidenta republiky. Pravomocem prezidenta republiky je věnována zvýšená pozornost z důvodu nedávné velmi zásadní změny ústavného zákona, kterým bude umožněna přímá volba prezidenta. Česká republika je státem a stát je současně určitou organizovanou politickou mocí disponující silovými prostředky. Koncentruje ve svých rukou mocenské pro¬středky a tyto užívá na určitém území a ve vztahu k obyvatelstvu na tomto území žijícímu, má výlučnou politickou autoritu. Státní moc v České republice je podle Ústavy odvozena od lidu a je vykonává třemi typy orgánů-mocemi, zákonodárnou, výkonnou a soudní. Práce se věnuje všem uvedeným druhům státní moci, velký důraz je kladen z hlediska zachování demokratického státu na úlohu soudnictví a v tomto případě stěžejně Ústavnímu soudu jakožto nástroji ochrany ústavnosti a jeho judikatuře. Nelze opomenout úlohu a postavení dokumentů chránících základní práva a lidské svobody, jejich vznik a úlohu v dnešním světě. Tato práva jsou páteří ústav většiny demokratických států a těší se důsledné právní ochraně i na mezinárodní úrovni, např. prostřednictvím Evropského soudu pro lidská práva. V neposlední řadě hodnotíme vliv komunitárního a unijního práva na ústavní pořádek ČR. Vstupem ČR do Evropské unie k 1. 5. 2004 došlo určitým způsobem k nepatrnému oslabení suverenity státu, prostřednictvím závazků pramenících z mezinárodních smluv, s jejichž případným opomenutím nebo jiným nerespektováním je spojována mezinárodněprávní odpovědnost. Lisabonské smlouvě je věnována samostatná kapitola, jako smlouvě, která zásadním způsobem mění zakládající smlouvy Evropské unie a její instituciální rámec, hlavně posílení Evropského parlamentu. Velkou úlohu před její ratifikací sehrál Ústavní soud ČR, který ji posuzoval z hlediska souladnosti s ústavním pořádkem ČR. Závěr práce řeší otázky přímé či nepřímé demokracie, tj. míry možnosti občanů ČR podílet se na budování a zachování demokratického státu.

Abstract:

The main task of the thesis is to consider whether the legal order in the CR serves maintaining principles of a democratic state based on basic rights of citizens. That has been done in historical connection with the creation of constitution, not only from the point of diverse constitutional development of the Czech Republic but also of the former Czechoslovak Republic. There have also been analysed key models of legal cultures in the world considering the influence of foreign constitutional systems. Constitutional system has been assessed in terms of its place in the pyramid of legal norms. The thesis describes the legislative procedure of adopting legal norms, including its institutional arrangements, the position of both the chambers of the Parliament in the CR, the role of the government and of the President of the Republic. Great attention is devoted to the powers of the President of the Republic with regard to the recent significant change in the constitutional law which shall allow direct election of the President. The Czech Republic is a state. And the state is at the same time the organised political power which has power resources at its disposal. It concentrates power resources in its hands and uses them on a certain territory and in relation to the population living on the territory, it has exclusive political power. The state power in the Czech Republic is, in compliance with the Constitution, derived from the people and is exercised by three types of bodies, i.e. legislative, executive and judicial powers. All these types of state power have been considered from the point of the state conservation, the role of justice system and primarily the Constitutional Court as an instrument of the protection of constitutionality and its jurisprudence. The role and the position of the documents securing basic human rights and liberties, their origin and their role in the contemporary world cannot be ignored. These rights form the backbone of the constitution in most democratic states and enjoy legal protection on the international level as well, for example through the European Court for Human Rights. Last but not least, the influence of the community and union law on the constitutional order in the CR has been evaluated. Accession of the CR to the European Union on 1 May 2004 led to a certain weakening of the sovereignty of the state due to the obligations arising from the international treaties where the state takes the international legal responsibility for any omission or neglect of them. Special chapter is devoted to the Lisbon Treaty as the treaty which significantly changes the founding treaties of the European Union and its institutional framework, mainly the strengthening of the European Parliament. The great role before its ratification was played by the Constitutional Court of the CR which assessed it from the point of its compliance with the legal order in the CR. The thesis in its conclusion solves the issues of direct or indirect democracy, i.e. the extent of opportunities of the citizens of the CR to which they can participate in building and maintaining the democratic state.
