Abstract:
Úpadek či hrozící úpadek a způsoby jeho řešení upravuje insolvenční zákon. Úpadek či hrozící úpadek dlužníka lze řešit několika způsoby, kterými jsou konkurs, reorganizace a oddlužení. Insolvenční řízení lze zahájit pouze na návrh dlužníka nebo věřitele. Insolvenční návrh musí obsahovat předepsané náležitosti. Lze s ním spojit návrh na povolení oddlužení. The Insolvency Act regulates the metods how to solve a failure or nemace of a failure with. Generally used methods for solving these situation are bankruptcy, reorganization and disencumbrance. The insolvency application must give all the prescribed requirements. It can be passed together with the request for disencumbrance or reorganization.
