Cyber Crime and Specifics of its Evidence

Abstract:

Předkládaná práce se zabývá kriminalitou ve specifickém prostředí počítačových systémů a jejich vzájemného propojení. Úvodem jsou v práci vysvětleny základní pojmy a výrazy, další část poskytuje obecný vhled do historie problematiky. Hlavní část je věnována současné české trestněprávní úpravě počítačové kriminality, zejména uvedení vybraných skutkových podstat trestných činů a jejich vzájemné odlišnosti, dále uvedení aplikační činnosti soudů České republiky, jakož i nástin z pohledu mezinárodního práva. V neposlední řadě je v práci věnována pozornost samotnému vyšetřování a dokazování této trestné činnosti a rovněž specifičnosti osoby pachatele, zejména z pohledu policejního orgánu. Společně s tímto je poukázáno na jistou nepružnost legislativy spojené s odhalováním této zvláštní trestné činnosti v závislosti na poměrně rychlé expanzi počítačového prostředí do běžného života člověka.

Abstract:

The presented Bachelor thesis deals with crime in the specific environment of computer systems and their interconnections. In the introduction of the thesis there are explanations of the basic concepts and terms, the next section provides a general insight into the history of the issue. The main part of bachelor thesis is devoted to contemporary Czech criminal regulation of cyber crime, especially there are presented differences beetwen crimes and selected types of constituent elements of offenses. There is indicated the application activity of the courts of the Czech Republic, as well as an example of international law. Last but not least, the bachelor thesis focuses on the investigation and proving of this crime, as well as the specificity of person of the offender, especially in view of the police authority. Along with this is pointed out inflexibility of legislation associated with the detection of this particular crime, depending on the relatively rapid expansion of computing environments into common life.
