Defence of a defendant in trial

Abstract:

Obhajoba obžalovaného v hlavním líčení je realizací jeho práva hájit se sám či prostřednictvím zvoleného či ustanoveného obhájce v průběhu trestního stíhání. Toto právo je garantováno jak Ústavou, Listinou základních práv a svobod a mezinárodními úmluvami tak i zákonem. Je tedy na jedné straně prostředkem obžalovaného k ochraně jeho práv a na straně druhé je pro stát a jeho orgán soud, institutem, který zajišťuje legalitu trestního stíhání a rozhodnutí o vině a trestu. Stát garantuje obžalovanému jeho právo vystupovat v hlavním líčení a hájit tak svá práva prostřednictvím obhájce, kterého si může ve všech případech zvolit a v některých případech je mu dokonce ustanoven bez ohledu na jeho vůli. Jedná se o ty případy, kdy uznal zákonodárce za nutné z různých důvodů zajistit kvalifikovanou ochranu práv obviněného.

Abstract:

Defence of the accused in the main trial is the implementation of his right to defend himself or be defended by a chosen or assigned defence lawyer during the legal prosecution. This right is guaranteed by the constitution and international agreements as well as by the law. The right to defence is one of the most important basic rights of persons who are being prosecuted and is aimed at reaching a just and fair decision. It is embodied in the provision of article 40, paragraph 3 of the Bill of human rights and in the provision of article 2 paragraph 13 of the legal code. The purpose of the right to defence is the protection of interests of the defendant to enable proper and timely clarification of facts, which free the defendant of his guilt or mitigate his guilt, also the clarification of facts from the point of view of the defence, i.e. including its legal judgment and protection of all rights of the defendant in the course of the entire trial and also in different partial questions to prevent violation of procedural rights of the defendant and any interference with his rights and freedoms guaranteed by the constitution.
