Abstract:

V poslední době se ve světě ale i v České republice zvyšuje násilná trestná činnost, proto se práce zabývá využitím metody kriminalistického experimentu ve spojení s objasňováním a vyšetřováním této činnosti policejním orgánem. Cílem práce je zjistit jaké jsou nové metody kriminalistického experimentu a jejich využití v praxi. Práce popíše kriminalistický experiment jak ze strany trestního práva, tak i z kriminalistického pojetí. V první části se autorka věnuje obecně kriminalistice a její historii. Poté se zaměří na další kriminalistické metody a detailně právě na kriminalistický experiment. Popíše pojem a podstatu, odliší kriminalistický experiment od vyšetřovacího pokusu, zaměří se na druhy kriminalistického experimentu, přiblíží, jaká je příprava na provedení kriminalistického experimentu, kdo jsou účastníci kriminalistického experimentu, jaká je taktika provedení, dokumentace a hodnocení výsledků. Dále se zaměří na využití kriminalistického experimentu v zahraničí. V závěru se zaměří na nové metody kriminalistického experimentu a jejich využití v praxi.

Abstract:

Recently, violent criminal activity has been increasing in the world and in the Czech Republic, therefore the work deals with the use of the criminalistic experiment method in connection with the clarification and investigation of this activity by the police. The aim of the thesis is to find out what are the new methods of criminalistic experiment and their use in practice. The thesis will describe a criminological experiment both from the point of view of criminal law and from the criminological concept. In the first part, the author deals with criminology in general and its history. After that, he will focus on other criminological methods and in detail on the criminological experiment. It will describe the concept and essence, distinguish a criminalistic experiment from an investigative attempt, focus on the types of criminalistic experiment, explain what the preparation for conducting a criminalistic experiment is, who are the participants in a criminalistic experiment, what are the tactics of execution, documentation and evaluation of the results. Furthermore, it will focus on the use of the criminological experiment abroad. In the end, he will focus on new methods of criminological experiment and their use in practice.
