Abstract:

Tématem bakalářské práce je zaměření se na některá úskalí související s uzavíráním rozhodčí smlouvy v obchodním styku. Na skutečnosti, kterým je potřeba věnovat pozornost, aby se kontrahenti rozhodčí smlouvy vyvarovali některým negativním aspektům, které mohou nastat. Především pak určení počtu a osob rozhodců, poté na otázku procesních pravidel podle kterých bude, resp. má být v řízení postupováno, na rozhodčí smlouvu uzavřenou ve formě rozhodčí doložky, tzn. rozhodčí smlouvu týkající se všech sporů, které by v budoucnu vznikly z určitého právního vztahu nebo z vymezeného okruhu právních vztahů. Dále na okruh subjektů, které jsou z rozhodčí doložky oprávněny spor projednat a rozhodnout, na jednoho reprezentanta tzv. arbitrážních center, jakožto i na reprezentanta tzv. stálých rozhodčích soudů.

Abstract:

The theme of this Bachelor’s Thesis is to focus on some dangerous aspects related to conclusion of arbitration agreements in the course of business relations and which situations we should pay attention to in order that the contracting parties to the arbitration agreement would avoid certain negative aspects which can occur. We should be primarily paying attention to the number and type of arbitrators and subsequently to the issues of the process rules according to which the hearing will or should be proceeding. We should also pay attention to arbitration agreements concluded in the form of arbitration clause, i.e. arbitration agreements related to all disputes which may arise in the future as a result of certain legal relations or certain specifically defined legal relations. Further, we should pay attention to the range of subjects which using the arbitration clause have the authority to discuss the dispute and to make a decision about it, to one representative of the so-called arbitration centres, as well as the representative of the so-called permanent arbitration courts.
