Exclusive Contentions in Insolvency and Executory Proceeding

Abstract:

Cílem diplomové práce je analyzovat vylučovací spory v exekučním a insolvenční řízení. Práce systematicky zařazuje vylučovací spory mezi další spory vznikající v těchto řízeních a popisuje jejich základní znaky. Těžiště práce spočívá v detailní analýze vylučovací žaloby, jakožto základního prostředku ochrany třetích osob. Rovněž je rozebírán princip ochrany práv třetích osob v exekučním a insolvenčním řízení. Dále jsou hodnoceny slabiny platné právní úpravy spojené se závěrečnými návrhy na zefektivnění české právní úpravy.

Abstract:

The aim of the diploma thesis is to analyse the exclusive contentions in the insolvency proceeding, as well as in the executory proceeding. The exclusive contentions are systematically classified between the other contentions emanating from both proceedings. Their main characteristics are described later on. The diploma thesis focuses on the detailed analysis of the exclusive charge as a main instrument for the protection of third parties. The principle of the protection of the third parties in insolvency and executor proceeding is described itself. Finally, the weaknesses of the current legal regulation are examined, and in the end, suggestions for improvement of the Czech legal regulation are presented.
