Police of the Czech Republic as administrative authority for weapons and ammunitions

Abstract:

V zájmu každé společnosti je bezesporu zajištění bezpečnosti členů této společnosti, ochrana jejich života, zdraví a majetku. Jednou z oblastí dotýkající se bezpečnosti společnosti je i problematika zbraní a střeliva. Je to oblast velice široká a specifická a z tohoto důvodu jsem se rozhodla poskytnout základní přehled o této oblasti ve své práci. Hlavním cílem mojí práce je charakterizovat správu na úseku zbraní a střeliva, zařadit ji do systému veřejné správy České republiky, rozebrat právní úpravu v této oblasti a podrobněji uvést jednotlivé druhy správních činností na úseku zbraní a střeliva. Na čtenáři samotném je pak, aby si udělal vlastní názor a celkový náhled na základě předložených informací. V první části této práce se věnuji obecně systému veřejné správy, výkonu a organizaci státní správy na úseku zbraní a střeliva v České republice a popisuji zde také základní úkoly Policie České republiky v této oblasti. Druhá část práce je věnována vývoji právní úpravy na úseku zbraní a střeliva, včetně využívaných předpisů v této oblasti. Také zde zmíním informační systémy, které jsou policií využívané nejen při výkonu státní správy v oblasti zbraní a střeliva. Třetí část práce popisuje správní řízení nejprve obecně, dále pak konkrétně na úseku zbraní a střeliva, jsou zde uvedena konkrétní správní řízení využívaná v této oblasti. Ve čtvrté části práce se zabývám správními delikty a přestupky vyjmenovanými v zákoně o zbraních a střelivu. Ve svojí práci se snažím přiblížit problematiku zbraní a střeliva v naší zemi i člověku nezasvěcenému do této oblasti. Uvádím základní charakteristiky správy na úseku zbraní a střeliva včetně jejího zařazení do systému veřejné správy České republiky. Věnuji zde místo široké právní úpravě a příkladům jednotlivých správních řízení, které probíhají na úseku zbraní a střeliva, a zmiňuji i správní delikty postihující nedovolené jednání nebo neplnění povinností dotčených osob. Česká republika je země, kde má dlouholetou tradici myslivost a sportovní střelba, a to zcela jistě ovlivňuje počet střelných zbraní a jejich držitelů v naší společnosti. Naše legislativa je v tomto ohledu, dle mého názoru, nastavena zcela optimálně. Přestože se zdá být velmi volná, co se týká možností nabytí zbraně, o to je důslednější v samotném systému kontroly a evidence střelných zbraní. V současné době platný zákon o zbraních se zdá být velice podařeným.

Abstract:

Safety of the general public, protection of life, health and property is in the interest of every society. One of the areas closely connected to public safety is the issue of arms and ammunition. It is a very wide and specific field and therefore I have decided to offer a basic overview of this area in my work. The main aim of my work is to describe administration of arms and ammunition in the context of public administration of the Czech Republic, analyze legislation of this area and show in detail individual types of related administrative activities. The reader can gain a general overview and come to his or her own conclusion based on the presented information. In the first part of my work I deal with the public administration in general, its organization and activities in the area of arms and ammunition in the Czech Republic and I also describe related competences of Police of the Czech Republic. The second part of my work covers development of legislation of arms and ammunition, including legal regulations used in this area. I also mention information systems used by the police not only for administration in the area of arms and ammunition. The third part initially describes administrative process in general. It further covers specific administrative steps used in the area of arms and ammunition. In the fourth part I deal with the types of administrative offence listed in the arms and ammunition law. In my work I attempt to explain arms and ammunition issues in our country even to a person not well informed about this area. I present basic description of administration in the area of arms and ammunition, including its integration into the public administration system of the Czech Republic. I address general legislation, show examples of individual administrative processes taking place in the area of arms and ammunition and also mention types of administrative offence including incorrect behavior or a failure to fulfill obligation on the part of concerned persons. The Czech Republic is a country with a long tradition of hunting and sport shooting which most definitely influences the number of arms and their owners in our society. Our legislation is, in my opinion, absolutely appropriate in this area. Although it may seems too liberal with regards to the opportunity to acquire a weapon, the firearms supervision and evidence system is very strict. The current arms and ammunition law seems to be a good piece of legislation.
