Influence of state administration on the exercise of rights and duties of forest owner

Anotácia:

Tématem diplomové práce je vliv státní správy na výkon vlastnických práv a povinností vlastníka lesa. Základní výzkumnou otázkou je analýza efektivnosti právní úpravy a výkonu státní správy v lesnictví ve vztahu k právům a povinnostem vlastníka lesa, a to za situace kůrovcové kalamity. Práce nejprve čtenáře informuje o právních pramenech, z nichž práce i problematika státní správy v lesním hospodářství vychází. Následuje popis historie dané problematiky a popis jednotlivých subjektů i objektů majících vliv na vlastníka lesů a jeho lesní hospodářství. Zásadní důraz je v souladu s cílem práce kladen na vymezení vlivu orgánů státní správy na vlastníka. To jak na úseku lesnictví, tak i myslivosti v kontextu kůrovcové kalamity a následnou obnovu lesů. Část práce je věnována i mimořádným opatřením státní správy lesnictví, jimiž napomáhá vlastníkům řešit následky nejrozsáhlejší lesní kalamity v naší novodobé historii. V závěru práce je v pěti bodech navrženo několik možných opatření, jež by mohly zlepšit fungování státní správy v lesním hospodářství. Široká veřejnost od majitelů lesů požaduje minimálně udržení rozlohy i kvality lesů se všemi jejími pozitivy. Ať už je to funkce lesů rekreační, produkce kyslíku, ochrana půd i pozitivní vliv na klima celé planety.

Abstract:

The topic of the diploma thesis is the influence of the state administration on the exercise of ownership rights and obligations of the forest owner. The basic research question is an analysis of the effectiveness of legislation and the performance of state administration in forestry in relation to the rights and obligations of the forest owner in the situation of bark beetle calamity. The thesis first informs the reader about the legal sources on which the work and issues of state administration in forestry are based. The following is a description of the history of the issue and a description of individual subjects and objects influencing the forest owner and his forest management. In accordance with the aim of the thesis, fundamental emphasis is placed on defining the influence of state administration bodies. Both in the field of hunting and forestry per owner in the context of bark beetle calamity and subsequent forest regeneration. Part of the thesis is also devoted to extraordinary measures of the state forestry administration, which helps owners to deal with the consequences of the most extensive forest calamity in our modern history. At the end of the thesis, several possible measures are proposed in five points that could improve the functioning of the state administration in forestry. At the same time, they helped forest owners to streamline the management of their forest assets. This is to maintain a positive influence of forests for the general society, from recreational to a fundamentally positive impact on the climate of our entire planet.
