The Protection of Horses against the Abuse

Abstract:

Diplomová práce shrnuje a rozebírá ochranu koní před týráním z různých úhlů pohledu. Úvodní část práce čtenáři představuje koně jako takového, definuje právní pojmy a shrnuje relevantní právní úpravu. Stěžejní část práce spočívá v podrobném rozboru jednotlivých oblastí ochrany koní. Objasňuje čtenáři právní rámec i případné nedostatky. Věnuje se ochraně koní zejména v souvislosti s přepravou, veřejným vystoupením, ustájením, krmením a napájením, či s výcvikem. Nastiňuje ale také problematiku jatečních a pokusných koní. Následně se věnuji orgánům ochrany koní z hlediska veřejnoprávního i soukromoprávního, vymezuji odpovědnostní vztahy a to ve smyslu odpovědnosti správněprávní, trestněprávní i občanskoprávní. Závěrečná část práce spočívá ve čtyřech stručných kapitolách, ve kterých nabízím srovnání s německou právní úpravou, postup při podezření z týrání koní i související judikaturu a konkrétní případy týrání koní. Cílem diplomové práce je jednak shrnutí právní úpravy ochrany koní před týráním, ale i upozornění na nedostatky či právní mezery.

Abstract:

This thesis summarizes and discusses the protection of horses against the abuse in different perspectives. Introductory part of the thesis presents the horse like the animal, defines the legal terms and summarizes the relevant legislation. The main part of the work analysis of individual areas of horse protection detailed. It explains the legal framework and any of deficiencies. It is about protection of horses in transport, public appearances, stabling, feeding and power, or about training. But also outlines the issues about experimental and slaughter horses. Then the work describes horse protection authorities in terms of public and private. I defined the relationship and responsibility in the sense of responsibility of administrative law, criminal and civil liability. The final part consists of four short chapters, which offer a comparison with the German legislation, a suspected abuse of horses and related case law and specific cases of mistreatment of horses. The work is a summary of legislation protecting horses against the abuse, but also notice the shortcomings or gaps.
