The Culpable Insanity and its Criminal Sanction

Abstract:

Tato diplomová práce se zabývá problematikou zaviněné nepříčetnosti a jejího trestněprávního postihu. V první části se zaměřuji na základní aspekty dané problematiky, bez jejichž znalosti se dále v práci neobejdeme. Dále se v práci zmiňuji o historii zaviněné nepříčetnosti, o možných způsobech přivedení se do stavu nepříčetnosti. Po té se zabývám problematikou zaviněné nepříčetnosti jako takové. Vysvětluji, jak zaviněnou nepříčetnost dělíme, jaké jsou důvody a praktické dopady tohoto dělení. Naší současnou právní úpravu porovnávám s úpravou stejné problematiky v Německu. V závěru práce vysvětluji svůj postoj k dané problematice.

Abstract:

This thesis deals with problems of caused insanity and its criminal penalties. First part of this thesis focuses on basic aspects of the problem, which are necessary to understand the chosen theme. Thereinafter the history of caused insanity and possible ways of bringing oneself into the state of insanity are mentioned. After that, caused insanity as such is explored. There are divided different types of caused insanity and mentioned reasons and practical implications of that division. In the next part our current legal regulation is compared to the regulation in Germany. In conclusion of the work I interpret my opinions on that matter.
