Abstract:

Tato diplomová práce představuje historii ukládaných trestu a způsoby trestání na českém území až do dnešního dne. Pro pochopení, proč existují tresty, jsou v druhé kapitole práce popsány hlavní teoretické směry o účelu trestu a podrobněji jsou rozebrány jednotlivé argumentace těchto teorií. Ve třetí kapitole je tato práce zacílena na analyzování jednotlivých druhů trestů v českých právních předpisech. Ve čtvrté kapitole diplomová práce neopomíjí ani jaké tresty jsou ukládány v jiných státech ve světě, proto je část práce zacílena i na zkoumání, kde jsou vykonávány tělesné tresty a tresty smrti. Cílem práce je analýza platných druhů trestů a na jejím základě konstatování, zda má český právní řád dostatečně rozmanité a účelné druhy trestů v porovnání s vybranými jinými státy světa.

Abstract:

This diploma thesis is introducing history of punishments and their forms in czech territory till nowdays. To understand, why are punishments existing, in chapter two there are described main theories of punishment purposes, and also in detail analyzed arguments of each of those theories. In third chapter is this thesis concentrated on analyzing each punishment described in czech law as individual. In fourth chapter this thesis isnt neglecting which punishmentas are given in other countries on the World. That is why this chapter is also concentrated on punishments as death penalty and judical corporal punishments. The goal of this thesis is to analyze valid punishments and according this analyzing to state if a czech law has useful and sufficiently diversioned types of punishments in comparation with other choosen countries in the World.
