European Union and Its Disputes in WTO

Abstract:

Práce se zabývá obchodními spory řešenými na půdě Světové obchodní organizace, ve kterých vystupuje Evropská unie jako jeden z aktérů. Jejím cílem je vybrat významné obchodní spory vedené s dalšími státy, podrobně je představit a zjistit, jakým způsobem byly řešeny. V rámci práce bylo zjištěno, že přímý účinek práva není upraven primárním ani sekundárním právem EU, proto vychází z judikatury ESD. Hlavním zdrojem sporů je snaha EU chránit zájmy svých výrobců a ochrana zdraví před riziky, která mohou vyplývat z rozdílných vládních předpisů v různých státech. Práce se zaměřuje zejména na obchodní spory vedené se Spojenými státy od 90. let až po současné případy.

Abstract:

This work deals with commercial disputes within the World Trade Organization, in which the European Union acts as one of the actors. Its purpose is to select important trade disputes with other states, to introduce them in detail and to find out how they have been dealt with. In the work, it was found that direct effect is not regulated by primary or secondary EU law, therefore it is based on ECJ case law. The main source of disputes is the EU's efforts to protect the interests of its producers and protect health from the risks that may arise from different government regulations in different countries. The work focuses mainly on commercial disputes with the United States from the 1990s to present cases.
