Position of Residents of the European Union - Individuals without EU citizenship

Abstract:

Diplomová práce se zabývá postavením obyvatel Evropské Unie – jednotlivců bez občanství EU. Práce by měla sloužit k vytvoření přehledné a ucelené představy o právním postavení cizinců dlouhodobě pobývajících v EU. Práce zahrnuje výklad komunitární právní úpravy a výklad české právní úpravy včetně změn, které nastaly v nedávné době. Hlavním cílem této práce je poskytnout kompletní přehled o právech garantovaných cizincům, kteří jsou dlouhodobě pobývajícími rezidenty EU. Za tímto účelem jsem vytvořila srovnání práv vybraných kategorií cizinců s právy občanů EU. Z důvodu omezeného rozsahu této práce se nebudu zabývat postavením všech kategorii cizinců pobývajících na území EU. Primárně se zaměřuji na cizince s trvalým pobytem resp. na dlouhodobě pobývající rezidenty EU, v omezeném rozsahu na cizince s dlouhodobým pobytem a na cizince, kteří získali postavení vysoce kvalifikovaného pracovníka. Nebudu se věnovat ani otázkám uprchlictví a azylu, stejně tak není předmětem této práce postavení výzkumných pracovníků, studentů a obětí trestného činu obchodovaní s lidmi aj. Nebudu se věnovat ani krátkodobým pobytům jako jsou pobyty sezónních pracovníků.

Abstract:

This diploma thesis is concerned with the Position of Residents of the European Union - individuals without EU citizenship. I attempted to create brief and systematic interpretation of legal position of foreigners residing in EU. The diploma thesis covers interpretation of European legislature as well as Czech legislature and changes in which occurred recently. The main aim of this thesis is to provide complete overview of rights guaranteed to foreigners who are long-term residents in EU. For this purpose I have created a comparison between the rights of selected categories of foreigners with rights of citizens of EU. Due to restricted range of this thesis, I will not deal with the position of all categories of foreigners residing in EU. Primarily, I focus on the long-term residents, highly qualified workers, as well as family members of citizens of EU who are citizens of the third states. However, the diploma thesis does not cover the issue of refugees. Similarly, I will not deal with the issue of visa or the position of short-term residents such as the status of research workers, students and seasonal workers or victims of human trafficking etc.
